Terms of Service

1. Acceptance of Terms
By accessing or using Arch Tools ("the Service"), operated by MCMetaverse LLC, a South Carolina limited liability company, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Arch Tools provides a pay-per-use API platform offering 53+ developer tools and AI agent utilities including web scraping, AI text generation, image generation, audio transcription, text-to-speech, email delivery, crypto data, AI Oracle reasoning, conversational Session API, and more. Access is granted via API key upon registration. Credits are consumed per API call. Arch Tools also offers monthly and annual subscription plans that refresh credits on a recurring basis.
Current subscription plans: Developer ($19/month), Pro ($49/month), Business ($149/month), and Enterprise (custom pricing — contact us). Annual billing is available at 17% off the monthly rate. One-time credit packs are also available: $9 for 5,000 credits, $49 for 30,000 credits, and $199 for 200,000 credits.
Bring Your Own Key (BYOK): Users may optionally provide their own API keys for supported third-party providers (Anthropic, OpenAI, xAI, Google, Brave Search, Tavily, and Exa) to route requests through their own accounts. BYOK usage is subject to the same acceptable use policies and does not exempt users from these Terms.
Service Directory: Arch Tools maintains a curated directory of AI-powered services. Directory listings are provided for informational purposes. Inclusion in the directory does not constitute an endorsement by MCMetaverse LLC.
3. Account Registration
You must provide a valid email address to register. You are responsible for keeping your API key confidential. Do not share your API key or allow unauthorized access to your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Reverse engineer, scrape, copy, resell, or sublicense the Service or its tool outputs
- Resell, transfer, or redistribute your API key or credits to any third party
- Attempt to exceed rate limits, bypass authentication, or abuse the platform
- Use the Service to generate spam, malware, or harmful content
- Use automated scraping to systematically extract tool definitions, schemas, or pricing data
- Violate any third-party rights or applicable laws
- Email tool: You may not use the email-send tool to send unsolicited commercial email (spam), in violation of the CAN-SPAM Act, GDPR, or any applicable anti-spam law. You are solely responsible for compliance with email regulations including obtaining proper consent from recipients.
- Image generation: You may not use the design-create tool to generate illegal, defamatory, sexually explicit, or harmful imagery, or to create non-consensual likenesses of real individuals (deepfakes). Content must comply with OpenAI's usage policies.
- Text-to-speech: You may not use the text-to-speech tool to clone voices without consent, produce fraudulent audio impersonations, or create content intended to deceive listeners about the source of the audio.
- AI-generated content: You are responsible for reviewing and validating all AI-generated outputs before use. Arch Tools makes no warranty as to the accuracy, completeness, or fitness of AI-generated content.
- AI Oracle: The AI Oracle endpoint (25 credits per call) provides premium reasoning with structured analysis. You may not use Oracle responses as authoritative legal, medical, or financial advice. All Oracle outputs carry confidence levels and must be independently verified before consequential use.
- Session API: The session-create and session-message endpoints maintain conversation context in-memory for the duration of a session. You may not use Session API to store, persist, or relay harmful, illegal, or abusive content. Sessions are ephemeral and not persisted to disk.
5. Credits and Billing
Free accounts receive 250 credits upon registration. Additional credits may be purchased via Stripe, one-time credit packs, or paid automatically via x402 USDC micropayments (supported on 15 blockchain networks). Subscription plans include monthly credit allocations that refresh each billing cycle. Overage beyond subscription credits is billed at one-time pack rates.
- Non-refundable: Credits and subscription payments are non-refundable except where required by applicable law.
- Non-transferable: Credits are tied to a single API key and account. They may not be transferred, sold, gifted, or assigned to any other account or party.
- Non-expiring (one-time packs): Credits purchased via one-time packs do not expire as long as your account remains in good standing.
- Subscription credits: Credits granted via monthly or annual subscription plans are refreshed at the start of each billing cycle. Unused subscription credits do not roll over to the next cycle and expire at cycle end.
- Subscription cancellation: You may cancel a subscription at any time via your account dashboard or by emailing [email protected]. Cancellation takes effect at the end of the current billing period. You retain access to subscription credits until the period ends. No partial refunds are issued for unused time.
- Auto-renewal: Subscription plans renew automatically at the end of each billing cycle using your payment method on file. You will receive a reminder email before renewal. To avoid being charged, cancel before the renewal date.
- No resale: Purchasing credits or subscriptions for the purpose of reselling access to the Service is strictly prohibited.
- Account suspension: Violation of these billing terms may result in immediate account suspension without refund.
5b. x402 Cryptocurrency Payments
Arch Tools supports x402 protocol payments in USDC stablecoin across 15 blockchain networks. By using x402 payments, you agree to the following:
- No refunds: Cryptocurrency payments are final once confirmed on-chain. Due to the nature of blockchain transactions, we cannot reverse, cancel, or refund x402 payments. This applies regardless of whether you used the credited API calls.
- Blockchain finality: Payment is considered complete upon on-chain confirmation. Network congestion, failed transactions, or insufficient gas fees are your responsibility. We are not liable for transactions that fail to confirm.
- Wallet responsibility: You are solely responsible for the security of your wallet, private keys, and seed phrases. We will never ask for your private keys. Lost wallet access does not entitle you to credit recovery.
- Supported networks: We support payments on Base, Ethereum, Arbitrum, Optimism, Polygon, and other networks as listed on our Fund page. Network availability may change with notice.
- Exchange rate: x402 payments are denominated in USDC. We are not responsible for any value fluctuations in other cryptocurrencies you may convert from.
5c. Facilitator-as-a-Service
Arch Tools offers facilitator services for x402 payment processing on behalf of third-party API providers. If you use our Facilitator-as-a-Service:
- Service fees: Facilitator fees are disclosed at the time of transaction and deducted from the payment amount before settlement to the service provider.
- Settlement timing: Settlements to service providers are processed according to the terms agreed between Arch Tools and the provider. End users interact only with the x402 payment flow.
- Liability: MCMetaverse LLC acts as a payment facilitator only. We are not responsible for the quality, availability, or performance of third-party services accessed through our facilitator. Disputes about service quality should be directed to the service provider.
- Compliance: By using our facilitator services, you represent that your use complies with all applicable laws, including money transmission regulations in your jurisdiction.
5a. Rate Limits
Rate limits are applied per API key per tier to ensure fair access for all users:
- Free tier: 30 requests/minute, 500 requests/day
- Developer ($19/mo): 60 requests/minute, 5,000 requests/day
- Pro: 120 requests/minute, 20,000 requests/day
- Business: 300 requests/minute, 100,000 requests/day
Burst allowances may apply. Sustained abuse of burst capacity may result in throttling or suspension. Rate limits are subject to change with reasonable notice.
5d. Agent Identity (Know Your Agent)
Arch Tools provides an Agent Identity system that assigns reputation scores and verifiable identities to AI agents. By using Agent Identity:
- Reputation scoring: Scores are computed algorithmically based on objective metrics including payment history, API usage patterns, error rates, and account age. Scores are not manually adjusted.
- Score visibility: Your reputation score may be visible to other users and service providers in the Arch Tools ecosystem to facilitate trust-based interactions.
- Dispute process: If you believe your reputation score is inaccurate, you may request a review by emailing [email protected] with specific details. We will investigate and respond within 14 business days.
- No guarantees: A high reputation score does not guarantee access to any particular service or preferential treatment. Service providers set their own trust thresholds.
- Account linkage: Agent identities are linked to your API key and wallet address. Creating multiple identities to circumvent reputation penalties is prohibited and may result in account termination.
5e. Service Directory
The Arch Tools Service Directory lists AI-powered services and tools. If you submit a listing:
- Accuracy: You represent that all information in your listing is accurate, current, and not misleading. You must update your listing promptly if any information changes.
- Removal: We reserve the right to remove any listing at our sole discretion, including for inaccuracy, inactivity, policy violations, or user complaints. You may request removal of your own listing at any time.
- No endorsement: Inclusion in the directory does not constitute endorsement, partnership, or certification by MCMetaverse LLC.
- Intellectual property: By submitting a listing, you grant MCMetaverse LLC a non-exclusive, royalty-free license to display your service name, logo, and description in the directory and related marketing materials.
6. Service Availability
We aim for high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
7. Intellectual Property
All content, code, and branding associated with Arch Tools is proprietary. Your data and outputs generated through the Service remain yours.
8. Privacy
We collect only your email address and API usage data. We do not sell your data. See our Privacy Policy for details.
9. Changes to Terms
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MCMETAVERSE LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) any AI-generated content is accurate, complete, or fit for any particular purpose; (c) the Service will meet your specific requirements; or (d) any defects will be corrected. AI-generated outputs may be inaccurate, biased, or incomplete. You are solely responsible for validating all outputs before use in any production, legal, medical, financial, or other consequential context.
We are not responsible for outages, inaccuracies, or failures caused by third-party services including but not limited to Anthropic, OpenAI, xAI, Google, ElevenLabs, Resend, CoinGecko, Brave Search, Tavily, Exa, or any other upstream provider.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MCMETAVERSE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE DOLLARS ($25.00).
SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to indemnify, defend, and hold harmless MCMetaverse LLC, its members, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; (d) any content you transmit through the Service; or (e) any AI-generated output you use or distribute based on use of the Service.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in South Carolina. You waive any objection to jurisdiction or venue in such courts.
14. GDPR / International Users
If you are located in the European Economic Area (EEA), our lawful basis for processing your personal data is the performance of a contract (providing the Service you signed up for). You have the right to access, correct, or delete your data at any time by emailing [email protected].
